Choosing Your Divorce Lawyer
Choosing the right divorce attorney can significantly increase your chances of getting that favorable outcome. Our years of experience in family law have shown us that the following qualities in lawyers are the most important when it comes to divorce:
Effective Representation
Most important of all, you need divorce lawyers who will defend your rights and push for a resolution that favors you in courtroom litigation as well as complex out-of-court negotiations.
Experienced Counsel
It is not enough that your divorce attorneys are well-versed in family law; they should be able to meaningfully apply this knowledge to the facts of your case. Most importantly, they should be able to help you understand your rights and present you with information that will empower you to make the best decisions for you and your family.
Excellent Record
You want divorce lawyers with a track record of successful representations and favorable resolutions. This tells you that they have a deeper understanding of not just family law, but how it applies in real-life situations and the litigation arena.
We at Messick Law, PLLC, understand all these, and we deliver. Our divorce attorneys in Minnesota will help you understand what you are entitled to. We will advocate for your best interests, even if it comes to a courtroom confrontation. We have a wealth of experience litigating every kind of family matter:
- Protection orders

- Child custody
- Child support
- Parenting time
- Property division, including businesses and family farms
- And more
Divorce Rules In Minnesota
One of the most notable characteristics of divorce in Minnesota is the state’s “no-fault” divorce law. This basically means that a spouse can ask the courts for a divorce even without pointing out a fault in the other spouse. This means the court can grant the divorce if one spouse requests it, even if the other spouse is in disagreement. Due to the “no-fault” divorce laws, the court will not consider who is “at fault” when deciding disputes such as child custody and property distribution.
Requirement Of Residence
In Minnesota, you can start your divorce proceedings only after you have been a resident in the state for at least 180 days or six months. This residency rule exists so Minnesota courts can properly claim legal authority over your case. Without this connection to our state, the court will not be able to make binding decisions about your marriage, properties or children.
This six-month requirement applies to everyone facing divorce – whether you are a longtime Minnesota resident or military personnel stationed here. Where you held your wedding ceremony does not matter. You can file in Minnesota even if you got married across the country or overseas, provided one of you has lived here for the required six months.
Your current living arrangements do not change this rule either. If you live apart or if one spouse has moved away, you can still file in Minnesota when either of you meets the residency timeframe.
