What is civil litigation?
Civil litigation refers to the court process for resolving civil (versus criminal) lawsuits. It covers a vast array of disputes, from business matters to personal injury to real estate disputes and more.
Litigation involves several phases, from the initial discovery (that is, the exchanging of information and gathering of evidence) to settlement negotiations to trial, if needed. Many civil disputes get resolved outside of court through settlements.
What’s the difference between conciliation court and district court?
Conciliation court is a forum for addressing civil disputes involving a monetary amount below $15,000.00. It is also known as small claims court. Disputes involving damages in excess of $15,000.00, or certain types of claims (title to real estate, injunctive relief, and defamation), must be brought in district court.
What’s the difference between a harassment restraining order (HRO) and an order for protection (OFP)?
In Minnesota, a harassment restraining order is specific to cases involving harassment. It prevents the perpetrator from contacting the victim by any means. There doesn’t need to be any kind of relationship between the victim and the perpetrator.
An order for protection is for domestic abuse cases involving romantic partners (or exes), family members or household members. It can also prevent the perpetrator from contacting the victim and can order them to stay away from certain locations. Both harassment restraining orders and orders for protection can be brought by a parent or guardian on behalf of a minor child.
How does a real estate partition action work?
Apart from specific performance (a court order directing action or inaction), a Partition is generally the sole remedy when there is a dispute between joint landowners. These cases involve asking the court to force a sale of a jointly owned property (or to split it into parcels, in certain cases). The proceeds are then allocated among the owners. These cases often arise from real estate disputes in which the co-owners can’t agree on how to manage the property or whether to keep it.
What are my options for resolving a breach of contract?
Generally speaking, the best option is to reach a favorable settlement with the other party to fix the breach, provide compensation or both. Failing that, you may need to file a lawsuit to hold them accountable in court. It’s wise to speak with a lawyer about the options in your specific case.
What disputes commonly arise in construction projects?
Construction disputes are relatively common, especially in larger, more complex projects. They frequently involve issues such as:
